Terms of Service

Effective Date: April 3, 2025

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”) and LockboxRack Inc. (“we,” “us,” “our”) regarding your access to and use of the LockboxRack platform, including all services, software, equipment, and digital or physical components thereof (collectively, the “Service”).

  1. Acceptance and Scope

By creating an account, using the platform, or occupying a lock box rack slot, you agree to comply with and be bound by these Terms and all associated policies, including but not limited to the Refund Policy for Realtors, Returns and Warranty Policy for Property Managers, Privacy Policy, and Complaints and Appeals Policy.

  1. Eligibility

You must be at least 18 years old and authorized to act on behalf of a licensed real estate agency, brokerage, or property management company. You are solely responsible for ensuring that your use of the platform is lawful in your jurisdiction.

  1. Account Responsibilities

Users are responsible for maintaining the security of their account credentials. Any activity conducted under your account will be deemed your responsibility unless proven otherwise.

  1. Fees and Subscription Terms

LockboxRack Inc. charges:
– A one-time setup fee per rack.
– A refundable security deposit per rack.
– A monthly subscription fee per occupied hook.

  1. Equipment Use and Rack Conduct

Use of rack space must conform to all LockboxRack operational rules. Unauthorized use, tampering, or physical modifications to racks may result in penalties, including forfeiture of deposit or removal from the platform. Property managers are responsible for maintaining the racks per the Returns and Warranty Policy.

  1. Suspension and Termination

LockboxRack Inc. reserves the right to suspend or terminate accounts due to:
– Non-payment,
– Abuse or misuse of the system,
– Violations of these Terms or related policies.

  1. Privacy and Data Use

Your personal data is handled in accordance with our Privacy Policy. By using the platform, you consent to our collection and use of data as outlined in that policy.

  1. Dispute Resolution

Disputes arising under these Terms shall be handled in accordance with our Complaints and Appeals Policy before formal legal action is initiated.

  1. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada where applicable. Disputes will be resolved exclusively in the courts located in Hamilton, Ontario.
